FarmFair — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FarmFair (the “Service”), an online classifieds marketplace for the Irish farming community. The marketplace is operated by FarmFair, based in Ireland (“FarmFair”, “we”, “us”). By creating an account, browsing, or posting a listing on FarmFair, you agree to these Terms.

Disclaimer: FarmFair is an advertising platform only. We do not vet users, verify listings, or mediate transactions between buyers and sellers. All arrangements made between users are at their own risk.

  1. Who may use FarmFair

Only users resident in Ireland (including Northern Ireland) may use FarmFair to create, publish, or manage adverts. You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for complying with all applicable Irish and EU laws in connection with your use of the Service.

  1. Your account and responsibilities

You are responsible for the accuracy of information you provide (including name, email address, phone number, county, and listing details) and for keeping your account secure. You warrant that all such information is true, accurate, and kept up to date. You agree not to share your login credentials or use another person’s account. You are responsible for all activity that occurs under your account.

  1. Listings and acceptable use

FarmFair is a community marketplace for lawful, accurate listings related to the agricultural sector. You agree that:

• All listings must be placed in the most appropriate category for the item or service. FarmFair may edit, reassign, or remove miscategorised listings (e.g., placing machinery parts in Livestock). Repeated misuse may result in suspension or termination.

• Listings must be truthful, not misleading, and comply with applicable laws and regulations (including animal welfare and consumer protection).

• Dogs and puppies are strictly prohibited from being advertised on FarmFair.

• Listings for items requiring a special licence or training (e.g., medicinal or veterinary products), controlled or endangered species, or regulated animal sales are strictly prohibited.

• You will not post illegal items; stolen property; weapons; controlled drugs or medicines; counterfeit goods; items that infringe intellectual property; adult services; or any content that is harassing, hateful, or otherwise inappropriate.

• You will not spam, scrape, harvest data, or interfere with the proper functioning or security of the Service.

  1. Payments, pricing, and refunds

• Listings are subject to a fee of €4 per advert (inclusive of applicable VAT if charged). Payment is processed via Stripe through our platform provider (Sharetribe).

• Payments are handled by Stripe. We do not store full card details on our systems.

• A listing is considered “published” once payment is successfully completed and the listing appears on the Service.

• Refunds: Listing fees are generally non-refundable once a listing is published. However, we may, at our discretion, issue a refund or credit in cases of duplicate payment, technical error, or where we remove a listing in error.

  1. Moderation, service changes, and removal

FarmFair may suspend, withdraw, or amend any part of the Site or Service at any time without liability. We may review, edit, refuse, or remove any listing or content at any time if it violates these Terms or applicable law, or to protect users or the integrity of the marketplace. We may suspend or terminate accounts that repeatedly violate these Terms or engage in fraud or abuse.

  1. Intellectual property You retain ownership of content you post, but grant FarmFair a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on the Service for the purpose of operating and promoting the marketplace. You warrant that you have all rights necessary to post the content you submit.

  2. Third-party services The Service is built on Sharetribe and uses Stripe for payments. Your use of Stripe is subject to Stripe’s terms and privacy policy. FarmFair is not responsible for third-party websites or services, or for any payment issues arising from Stripe or other providers.

  3. Disclaimers and limitation of liability

FarmFair is a classifieds platform. Except where required by law, we do not own, inspect, or guarantee the items or services listed by users, and we are not a party to transactions between buyers and sellers. We do not guarantee the accuracy of listings, verify users, or mediate disputes between users. Buyers and sellers act entirely at their own risk. To the fullest extent permitted by law, FarmFair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, lost profits, or loss of data arising from your use of the Service. Our aggregate liability to you for any claim is limited to the greater of (i) €20 or (ii) the amount you paid to us in the six months preceding the claim.

  1. Indemnity

You agree to indemnify and hold harmless FarmFair from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.

  1. Data protection and privacy

Your use of the Service is also governed by our Privacy Policy. We process personal data in accordance with Irish and EU data protection laws (GDPR).

  1. Changes to the Service and Terms

We may update the Service and these Terms from time to time. Material changes will be notified by posting the updated Terms with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

  1. Governing law and disputes

These Terms are governed by the laws of Ireland. The Irish courts shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, subject to any mandatory protections under consumer law.
